Review of current and recommended Leadbeater's Possum regulations governing logging

Abstract
A series of investigative reports have been produced that demonstrate, when considered in isolation at the individual coupe level as well as cumulatively at the broad scale landscape level, that the current regulatory framework governing logging operations in Victoria's Central Highlands is insufficient to ensure that Leadbeater's Possum individuals or colonies, the actual creatures themselves and the actual area of their inhabitation, are not destroyed, that is, are not eliminated from logging areas.

This report details:

a) that logging activities within coupe 300-537-0003 have occured within areas of forest required to be protected within mandatory Cool Temperate Rainforest "40m Ecological Rainforest Buffers" required under Flora and Fauna Guarantee Act 1988 (FFGA) Action Statement #238 for Cool Temperate Rainforest (inc. Appendix 1) and;

b) that the coupe access road for coupes 300-537-0003 and 300-537-0004 is located within a Cool Temperate Rainforest "40m Ecological Rainforest Buffer".

3. VicForests must not continue any logging operations, or "regeneration burn" activities, within areas of forest required to be protected within Cool Temperate Rainforest 40m Ecological Rainforest Buffers, including those identified within the attached report.

2. This report details:

a) logging activities that have occured within areas of forest required to be protected within mandatory Cool Temperate Rainforest "40m Ecological Rainforest Buffers" required under Flora and Fauna Guarantee Act 1988 (FFGA) Action Statement #238 for Cool Temperate Rainforest (inc. Appendix 1) and;

b) VicForests coupe demarcation tapes situated within Cool Temperate Rainforest "40m Ecological Rainforest Buffers".

2. This report details the presence of Leadbeater's Possum Zone 1A habitat within VicForests scheduled and active logging coupe 300-503-0003.

299-510-0002 - VicForests clear-fell logging in contravention of the Flora and Fauna Guarantee Act 1988

URGENT: 299-510-0002 - VicForests clear-fell logging in contravention of the Flora and Fauna Guarantee Act 1988 Action Statement #062 for the Leadbeater's Possum (Gymnobelideus leadbeateri) and the Central Highlands Forest Management Plan.

Attached to this letter is an Investigation Report; "Yellowdindi Road - Investigation Report - Leadbeater's Possum Habitat Management Prescriptions - inc APPENDIX A, B, C - FINAL.pdf". This report details logging that has occurred, is continuing to occur and is likely to continue to occur in areas of State Forests that must be included in the Special Protection Zone reserve.

All location details, survey methodology, results and discussion of the relevant circumstances are contained within the attached report.

This is the story of the Possum habitat to Paper supply chain. Government Ministers are ducking and weaving, Government Business Enterprises are denying any wrong doing, audit bodies are  awarding AFS certification.  MyEnvironment Inc believe that it is the responsibility of the industries that source this wood as raw material to conduct proper due diligence on their suppliers.

State drops illegal harvesting case

The Age |  August 10, 2012

THE state environment department has dropped a court case against state-owned logging agency VicForests for alleged illegal harvesting of protected rainforest.

The two parties have instead cut an out-of-court deal meaning VicForests is almost certain to avoid a potential fine of up to $29,000.

New report unearths systemic illegal logging practices in NSW’s native forests

Environmental regulations intended to prevent unsustainable logging and protect threatened species are frequently and systemically breached in NSW’s native forests, according to an Environmental Defender’s Office report commissioned by the Nature Conservation Council of NSW.
 
 The report, If A Tree Falls [link below], details a pattern of illegal logging operations that has resulted in the destruction of old growth forest, endangered ecosystems and habitat for threatened wildlife across the state. Forests NSW has failed to observe even basic precautions such as marking up habitat trees for exclusion and monitoring forestry contractors.
 
 “The Nature Conservation Council’s report has uncovered that an alarming number of the trees falling in our native forests today have been illegally logged,” according to Nature Conservation Council of NSW Chief Executive Officer  Pepe Clarke.

Unlawful Stream Logging by VicForests Contractors in Toolangi

When laws ain't quite laws?

VicForests has avoided legal indictment again, this time for allowing its contractors to dump logs in streams. The incident was investigated by DSE in an audit of operations last year and found VicForests contractor was liable for work suspension under the Sustainable Forests (Timber Harvesting) Regulations 2006. When VicForests were told by the DSE to award penalty points to their contractor, VicForest simply  disagreed and claimed that “VicForests applies its penalties via contracts where it is warranted.  We do not believe any deliberate conduct has occurred and do not believe it would be prudent to penalise the contractor in this instance.”.
